SIGN THE WAIVER

When we started the Avenues Bicycle Club back in 2020, it was really just a couple of friends getting together for rides on Thursday nights. We never anticipated the kind of growth we've witnessed over the last few years. With that in mind, we now require everyone participating in an ABC ride to sign our waiver (once per calendar year).

Waiver and Release of Liability

The risk of injury from the activities involved in this ABC Activities program is significant, including the risk of physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent paralysis and/or death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist. These risks include, but are not limited to: a. Injuries arising from the inherently dangerous nature of cycling; b. Injuries arising from collision with pedestrians, vehicles, other riders, and fixed or moving objects; and c. Injuries resulting from the actions taken or decisions made regarding medical or survival procedures.

I acknowledge, agree, and represent that I understand the nature of ABC Activities and that I am qualified, in good health, and in proper physical condition to participate in ABC Activities. I willingly agree to comply with the stated and customary terms and conditions for participation in ABC Activities. I further acknowledge that the ABC Activities will be conducted over public roads and trails and facilities open to the public during ABC Activities and upon which the hazards of traveling are to be expected. I further agree and warrant that if, at any time, I believe conditions to be unsafe, and/or I observe any unusual significant hazard during my presence or participation, I will immediately discontinue further participation in ABC Activities and bring such to the attention of ABC immediately.

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, FOREVER DISCHARGE, INDEMNIFY, AND HOLD HARMLESS ABC and USA Cycling, Inc., their its officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for ABC Activities ("Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property associated with my presence at or participation in ABC Activities, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation.

Severability. This Agreement is intended to be as broad and inclusive as permitted by applicable law, and if any portion of this Agreement is held invalid or void, I agree that the balance shall, notwithstanding, continue in full legal force and effect.

Entire Agreement. As to any claim arising out of or related to my attendance or participation in ABC Activities, this Agreement: (a) supersedes any previous oral or written promises or agreements; and (b) is not the result of or modified by any oral representations or statements of any officer, official, agent and/or employee of ABC. This Agreement contains the only agreement between the parties regarding the topics covered in this Agreement, and may only be modified or terminated in a writing signed by myself and ABC.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
